1. Acceptance of These Terms
These Terms of Use (“Terms”) govern your access to and use of the website located at doctaverse.com and any associated pages, content, calculators, diagnostic and algorithm pages, and clinical reference articles (collectively, the “Service”). The Service is operated by Gagahealth Private Limited (trading as “GagaHealth” / “gagahealthtech”), an India-based health-technology company (the “Operator”, “we”, “us”, or “our”), having its registered office in Bengaluru, Karnataka, India.
You accept these Terms by completing the affirmative acknowledgement presented on your first visit — by selecting the control confirming that you are a qualified healthcare professional and that you have read and agree to these Terms of Use and our Privacy Policy — and by your subsequent access to and use of the Service. By doing so you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Service.
The acknowledgement is recorded together with the version of these Terms then in force and the date of acceptance. Because this record may be stored locally on your device and can be cleared, you may be asked to confirm your acceptance again, including when these Terms are materially updated.
These Terms constitute a binding agreement between you and the Operator. They apply in addition to, and do not override, any applicable law, professional code of conduct, or regulatory obligation to which you are subject.
2. Eligibility — Qualified Healthcare Professionals Only
The Service is intended solely for use by qualified, registered, and licensed healthcare professionals (including physicians, pediatricians, nurses, pharmacists, and equivalent regulated clinicians) acting within their scope of practice and professional competence.
By using the Service you represent and warrant that:
- you are a qualified healthcare professional, duly registered and licensed in your jurisdiction;
- you are accessing the Service in your professional capacity; and
- you are at least the age of majority in your jurisdiction and have the legal capacity to enter into these Terms.
The Service is NOT intended for, and must not be used by, patients, parents, caregivers, or members of the general public. It is not a tool for self-diagnosis, self-treatment, or for diagnosing or treating any individual outside of a qualified clinician’s independent professional judgement. The content is technical clinical reference material that assumes specialist medical training to interpret and apply safely.
The professional-use acknowledgement you provide on first visit (recorded as a flag in your browser’s local storage) confirms your assent to these Terms and your professional status as represented by you. It does not create, transfer, or verify any professional credential, and does not waive or limit any provision of these Terms or any disclaimer below.
3. Intended Use and Medical Disclaimer — Decision Support Only
Intended use. The Service is intended and provided as general clinical reference and decision-support material for qualified healthcare professionals. It is designed to support, and not to replace, the independent clinical judgement of the treating clinician. It does not diagnose, prescribe, determine, or recommend treatment for any specific individual.
THE SERVICE PROVIDES CLINICAL DECISION SUPPORT AND REFERENCE INFORMATION ONLY. IT IS SUGGESTION-ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL CLINICAL JUDGEMENT. Specifically, and without limitation:
- Regulatory status / not marketed as a medical device. The Operator does not intend, market, or hold out the Service as a regulated medical device, in-vitro diagnostic, or accessory thereto, and the Service has not been registered, cleared, or approved as such by any regulatory authority. Regulatory classification of software depends on its intended use and function and varies by jurisdiction (including under the Medical Devices Rules, 2017 of India, the EU Medical Device Regulation, and the U.S. Food, Drug, and Cosmetic Act), and is ultimately a matter for the relevant regulator. We make no warranty as to the regulatory status of the Service in any jurisdiction. The Service is not designed to autonomously diagnose, treat, cure, monitor, prevent, or make clinical decisions for any patient.
- Independent review of the basis (decision-support design). Each calculator and diagnostic output is presented together with its inputs, the formula or criteria applied, the source or citation, and material assumptions, so that you can independently review the basis for any result. You must not rely on any output as the primary or sole basis for a clinical decision; the output is one input to your own independent professional judgement.
- No diagnosis or treatment. The Service does not diagnose any condition, nor prescribe or recommend any treatment, dose, or course of action for any specific individual. Any calculator output, diagnostic criterion, algorithm, or article is general reference information that must be independently verified and interpreted by the treating clinician in the context of the individual patient.
- No doctor–patient or professional relationship; no practice of medicine by us. Use of the Service does not create a doctor–patient relationship, a referral, or any professional, advisory, or fiduciary relationship between you (or any patient) and the Operator or its personnel. Nothing in the Service constitutes the practice of medicine, nursing, or pharmacy by the Operator or its personnel, the provision of professional advice to you or to any patient, or supervision of your practice. The content is general informational reference material only.
- Independent verification required. You must independently verify every output, value, criterion, and recommendation against current primary sources — including authoritative clinical guidelines, validated references, manufacturers’ product labelling, and institutional protocols — and against your own clinical judgement and direct assessment of the patient, before relying on it or acting upon it.
- Calculators and the role of AI. The calculators and diagnostic tools perform deterministic, unit-tested computations. Any artificial-intelligence (AI) features within the Service assist only with navigation, routing, retrieval, and explanation of content; AI does not compute clinical numbers and must not be relied upon as the source of any clinical value. AI-generated explanations may be incomplete, outdated, or incorrect and must be independently verified.
Heightened caution — dosing and drug-related tools. Any dose calculation, drug, or formulary-related output carries elevated clinical risk. Such outputs are reference figures only, generated by deterministic computation from the inputs you supply, and must be independently checked by you against current product labelling, authoritative dosing references, and your institution’s protocols — and confirmed as appropriate for the individual patient — before they are used or acted upon.
You, the professional user, remain solely and fully responsible for all clinical decisions, diagnoses, and treatment of your patients.
4. Accuracy and No Guarantee of Content
While we endeavour to draw on reputable sources and to test our calculators, we make no representation, warranty, or guarantee that any content on the Service is accurate, complete, current, reliable, error-free, or suitable for any particular patient or purpose. Medical knowledge, guidelines, and drug information evolve continually, and content may become outdated, contain errors or omissions, or conflict with other authoritative sources or with local protocols. References to any specific test, product, dose, guideline, or procedure are not endorsements.
5. “AS IS” / “AS AVAILABLE” — No Warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. To the fullest extent permitted by applicable law, the Operator disclaims all warranties, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, title, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure, timely, error-free, or free of viruses or other harmful components, or that defects will be corrected.
Some jurisdictions do not allow the exclusion of certain warranties; in such jurisdictions, the above exclusions apply to the maximum extent permitted by law.
6. Assumption of Risk
You acknowledge and accept that the practice of medicine involves inherent risk and professional judgement, and that reliance on any reference resource carries risk. By using the Service, you knowingly and voluntarily assume all risk arising from your use of, and any reliance on, the Service and its content. You agree that you are professionally competent to evaluate the content critically and that you will not use it as a primary or sole basis for any clinical decision.
7. Limitation of Liability
Mandatory carve-out (read first). Nothing in these Terms excludes or limits the Operator’s liability where it cannot lawfully be excluded or limited. In particular, nothing in this Section or these Terms excludes or limits liability for: (a) death or personal injury caused by the Operator’s negligence (whether ordinary or gross); (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under the applicable mandatory law (including any non-waivable statutory or consumer protection). The exclusions and the monetary cap in this Section do not apply to any of the foregoing.
Subject to the carve-out above, and to the fullest extent permitted by applicable law, in no event shall the Operator, or the persons identified in Section 8A, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, loss of data, loss of goodwill, or business-interruption damages, arising out of or in connection with your access to, use of, or inability to use the Service or its content, or any clinical decision, act, or omission made in reliance on it, whether based in contract, tort (including negligence), strict liability, statute, or any other legal theory, and whether or not the Operator has been advised of the possibility of such damages.
Subject to the carve-out above, and to the fullest extent permitted by applicable law, the total aggregate liability of the Operator for direct economic and other loss arising out of or relating to the Service and these Terms shall not exceed one hundred Indian Rupees (INR 100). You acknowledge that the Service is provided free of charge and that this allocation of risk is a reasonable and essential basis of the bargain.
Reading-down / reformation. If any exclusion or limitation in this Section is held invalid or unenforceable for any category of liability or in any jurisdiction, it shall be reformed and applied to the maximum extent permitted by applicable law for that category and jurisdiction, and its invalidity shall not affect the validity of the remainder of this Section or these Terms.
8. Intellectual Property and Limited Licence
The Service and all content, text, calculators, source code, algorithms, diagnostic criteria compilations, articles, design, graphics, logos, and trademarks (collectively, the “Materials”) are owned by or licensed to the Operator and are protected by copyright, trademark, database, and other intellectual-property laws. “doctaverse”, “GagaHealth”, and associated marks are trademarks of the Operator or its affiliates.
Subject to your continuous compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service and its content for your own professional clinical-reference purposes, including in the course of providing clinical care to your own patients. All rights not expressly granted are reserved.
You must not, except as expressly permitted by law or with our prior written consent: copy, reproduce, republish, scrape, mirror, frame, distribute, sell, licence, or commercially exploit the Materials; create derivative works; remove or alter any proprietary notices; or use the Materials to build, train, or improve any competing product, dataset, or model. The restrictions in this sentence survive termination of these Terms.
8A. Persons Protected (Third-Party Beneficiaries)
The disclaimers, warranty exclusions, assumption of risk, and limitations of liability in these Terms are made for the benefit of the Operator and of its affiliates, officers, directors, employees, contributors, clinical reviewers, licensors, and suppliers (the “Protected Persons”). The Operator enters into these provisions on its own behalf and, with respect to the Protected Persons, as agent and trustee for them, so that each Protected Person may enforce those provisions. Where local law so provides (including, in England and Wales, the Contracts (Rights of Third Parties) Act 1999), the Protected Persons may enforce those provisions directly. No other person has any right to enforce these Terms, and the consent of the Protected Persons is not required to vary or rescind these Terms.
9. Acceptable Use and Prohibited Conduct
You agree not to, and not to permit any third party to:
- use the Service in violation of any applicable law, regulation, or professional or ethical code;
- use the Service for any patient-facing, consumer-facing, or self-diagnostic purpose, or present it to patients or the public as a diagnostic or treatment tool;
- misrepresent your professional status or identity;
- interfere with, disrupt, overload, or impair the Service or its underlying infrastructure (including via automated scraping, bots, denial-of-service activity, or excessive requests);
- attempt to gain unauthorised access to any part of the Service, its systems, or networks;
- introduce malware or any harmful code;
- reverse-engineer, decompile, or attempt to extract source code or the logic of the calculators, except to the extent such restriction is prohibited by applicable law; or
- use the Service in any manner that could damage, disable, or impair it or interfere with any other party’s use.
10. Third-Party Links and Content
The Service may contain links to, or references to, third-party websites, resources, guidelines, or content. Such links and references are provided for convenience only. We do not control, endorse, or assume responsibility for any third-party content, products, services, or privacy practices. Your use of any third-party resource is at your own risk and subject to that third party’s terms and policies.
11. Service Changes and Availability
We may modify, suspend, add to, or discontinue any part of the Service, including any content or calculator, at any time and without notice or liability. We do not guarantee that the Service, or any specific content, will remain available. We are not liable for any unavailability, modification, suspension, or discontinuance of the Service.
12. Modification of These Terms
We may revise these Terms from time to time. The revised Terms will be posted on this page with an updated effective date and version. For material changes, we will take reasonable steps to bring the change to your attention (for example, an on-site notice or a renewed acknowledgement prompt). Your continued use of the Service after the revised Terms take effect, or your renewed acknowledgement where requested, constitutes your acceptance of them. If you do not agree to the revised Terms, you must stop using the Service.
13. Indemnity
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Operator and its affiliates, officers, employees, and agents from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) to the extent arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Service; (c) your misrepresentation of your professional status; or (d) your violation of any law or third-party right. This indemnity does not apply to, and you are not required to indemnify the Operator for, any claim to the extent it arises from the Operator’s own negligence, wilful misconduct, fraud, breach of these Terms or applicable law, or from errors in the Operator’s own content.
14. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes) shall be governed by and construed in accordance with the laws of India.
Subject to applicable mandatory law, the courts of Bengaluru, Karnataka, India shall have exclusive jurisdiction, and you consent to the personal jurisdiction of those courts. Nothing in this clause deprives a consumer of the protection of any mandatory law of their country of residence, including any right to bring or defend proceedings in the courts of that country where mandatory law so provides.
15. General
If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed (or read down under Section 7) and the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding the Service. You may not assign these Terms; we may assign them to an affiliate or successor.
Survival. Sections 3–8A (disclaimers, warranties, assumption of risk, limitation of liability, intellectual property, persons protected), 13 (indemnity), 14 (governing law and dispute resolution), and this Section 15 survive any termination or expiry of these Terms or of your access to the Service.
Force majeure. The Operator is not liable for any failure or delay in performance, or for any unavailability of the Service, caused by events beyond its reasonable control, including acts of God, outages or failures of third-party hosting, network, or telecommunications providers, cyber-attacks, strikes, governmental action, or other force-majeure events.
